The Mandate in the Event of Incapacity


This notarized document could become very useful:

  • Since 1990, The Civil Code of Quebec, authorizes the citizens of Quebec to choose a designated agent to exercise the powers of the mandate should an incapacity occur.
  • To loose one's capacity is less than thrilling, but, It remains a possibility and may occur at the least expected moment.
  • This important legal document stipulates that a person of your choice will:
  • Administer your assets if you are not capable of doing so.
  • Care for your children when you are unable to.
  • Accept care in your name when you become inapt to decide.
  • Without a mandate in the Event of Incapacity, a spouse, even if legally married, must be named by the court to administer your assets if you have become incapacitated.
